Dancify Privacy Policy

This Privacy Policy explains how Burgess Enterprises Inc (“Dancify,” “we,” “us,” or “our”) collects, uses, shares, stores, and protects information when you use Dancify, including our website located at www.dancifyapp.com, our mobile application, and related services collectively, the “Service.”
By using the Service, you agree to this Privacy Policy. If you do not agree, please do not use the Service.

Photos, Videos, and Generated Content
When you use Dancify, we may collect and process:
The only content you submit to create a video is the photo you upload. Dancify does not require or collect free-text prompts from you; you create a video by uploading a photo and selecting one of our built-in templates.
We only access photos that you choose to upload or submit through the Service. Granting access to your camera roll does not mean we collect your entire photo library.
Uploaded photos may include faces, bodies, pets, backgrounds, clothing, objects, and other personal information visible in the photo.
Face Data
This section explains, in plain terms, how Dancify handles face data. We provide it so that you, and platforms such as Apple, can clearly understand our practices.
What face data we collect. When you upload a photo to generate a video, that photo may contain your face or the face of another person in the image. We process the visible contents of the photo you upload, which may include facial appearance, facial proportions, expression, body position, and pose, only to the extent these are visible in the photo you choose to submit. We do not scan, import, or collect any photos other than the specific images you choose to upload.
How we use face data. We use the facial appearance contained in your uploaded photo for one purpose only: to generate the AI video you request. The photo is sent to our AI generation provider, which uses it to create a short video in which the person in the photo appears to move, dance, or perform according to the template you selected. The photo you upload is the only content we send to the provider; we do not send free-text prompts or your previously generated videos. As part of generating the video, the provider may detect the location of the face and body and apply motion, animation, mouth movement, or lip-sync-style facial performance to the image. We do not use face data for advertising, profiling, or any purpose other than producing the video you asked for.
We do not perform facial recognition or biometric identification. We do not use face data to identify or authenticate you as a specific individual, to verify your identity, to match your face against any database, or to create, store, or use a faceprint, face template, face embedding, or any other biometric identifier for identification purposes. We do not build a biometric identity profile of you.
Who we share face data with, and where it is stored. To generate your video, your uploaded photo is sent to our AI generation provider, Fal.ai, and to the AI models made available through Fal.ai. Fal.ai processes the photo solely to generate the requested video and returns the result to us. Fal.ai processes data according to its own privacy policy and terms, and may process it on servers located outside your country of residence. We store your uploaded photos, generated videos, previews, and thumbnails on Amazon Web Services (AWS) S3. We do not sell face data, and we do not share face data with advertising networks or data brokers.
How long we retain face data. We retain the face data contained in your uploaded photos only as long as needed to provide the Service. Your uploaded input photo is deleted from our systems automatically as soon as the video generation completes, whether the generation succeeds or fails. We do not keep your original uploaded photo after the video has been generated. The generated video is stored in your gallery while your account remains active, and you can delete it at any time. When you delete your account, your photos, generated videos, previews, thumbnails, and related media are deleted from our active systems, subject to the backup and legal exceptions described in the Retention section below.

Account Information
Dancify offers two sign-in options: Sign in with Apple and Google Sign-In. We offer Sign in with Apple as an equivalent login option that limits data collection to your name and email address and lets you keep your email address private through Apple’s private email relay.
If you use Sign in with Apple, we may receive an Apple account identifier, your email address if Apple provides it, your name if Apple provides it, and a private relay email address if you use Apple’s private email relay.
If you use Google Sign-In, we may receive a Google account identifier, your email address, and your name, as provided by Google. Google processes your sign-in according to Google’s own privacy policy. We use this information only to create and secure your account; we do not use Google Sign-In to track you for advertising.
Payment and Subscription Information
If you purchase a subscription, credits, one-time pack, or free trial through the Apple App Store, Apple processes your payment. We may receive limited information such as subscription status, credit balance, product purchased, renewal or expiration status, refund or cancellation status, and transaction identifiers. We do not receive or store your full payment card information for Apple App Store purchases.
Device, Technical, and Usage Information
We may collect or process device type, operating system, app version, generation attempts, template usage, screens viewed, dates and times of use, crash, error, or failed-generation information generated by our systems, and push notification tokens if push notifications are enabled.
We do not currently collect IDFA, advertising identifiers, or device identifiers for advertising tracking. We do not use Apple App Tracking Transparency because the app does not track users across apps or websites owned by other companies.
We do not intentionally collect precise or approximate location. Some infrastructure providers may process network information, such as IP addresses, as part of standard service delivery, security, and fraud prevention.
Marketing and Advertising Information
We may use Facebook/Meta advertising to promote Dancify outside the app. At launch, Dancify does not use Meta SDK, Meta Pixel, TikTok SDK, IDFA, advertising identifiers, or cross-app tracking inside the app.
If we later add Meta SDK, Meta Pixel, in-app event tracking, advertising identifiers, retargeting, custom audiences, or cross-app tracking, we will update this Privacy Policy and our App Store privacy disclosures as required before or when those tools are enabled.
Communications With Us
If you contact us, we may collect your name, email address, message content, screenshots, files, and other information needed to respond to your request.

4. AI Service Provider
Dancify uses a single AI generation provider, Fal.ai, and the AI models or services made available through Fal.ai. We do not use any other AI generation provider.
To generate your video, the only user content we send to Fal.ai is the photo you upload, together with the technical parameters that correspond to the built-in template you selected (for example, which model and motion to apply). We do not send Fal.ai any free-text prompts from you, and we do not send your previously generated videos.
Fal.ai and the AI models available through Fal.ai process the photo solely so that the requested AI video can be generated, and then return the result to us. Fal.ai and related model providers may process, store, retain, or use data according to their own privacy policies, terms, and data processing terms. We do not control all aspects of their processing.
We use commercially reasonable efforts to configure provider accounts in a privacy-protective way where available. AI providers may process information in countries outside your country of residence.
5. Cloud Storage and Infrastructure
We use cloud storage and infrastructure providers to store and deliver uploaded photos, generated videos, previews, thumbnails, and related media.
Our production storage uses AWS S3. We may change or add storage, hosting, or infrastructure providers in the future, and if we make material changes to our practices, we will update this Privacy Policy as required.
6. Music, Audio, Templates, and Lip-Sync
Generated videos may include music, audio, sound effects, voice-like sounds, mouth movement, or lip-sync-style facial performance from templates, reference videos, AI provider workflows, or other third-party sources.
We may process template audio, reference videos, and related media to generate and deliver the requested output. You should not extract, copy, reuse, resell, redistribute, or separately use any music or audio from Dancify templates unless you have separate rights to do so.
AI-generated lip-sync, mouth movement, facial performance, and audio timing may be imperfect or inaccurate.

We do not sell uploaded photos or generated videos. We do not currently share IDFA or advertising identifiers because we do not collect them.
8. Retention
We retain information only as long as needed for the purposes described in this Privacy Policy, unless a longer period is required or permitted by law.

9. Account Deletion and Data Deletion
You may delete your account from inside the app.
When you delete your account, we remove or de-identify personal information associated with your account from our active systems, including uploaded photos, generated videos, previews, thumbnails, and related media stored in AWS S3, unless retention is required or permitted for legal, security, fraud-prevention, accounting, backup, dispute, or compliance purposes.
Deleted data may remain in backups or replicated copies for up to 90 days before permanent deletion. During this period, backup copies may be retained for backup, recovery, security, legal, or compliance purposes and are not generally available through the Service.

10. User Gallery
Dancify may offer a user gallery or history where generated videos can be viewed, downloaded, or shared. Generated videos in your gallery are stored while your account remains active. Dancify is not a permanent backup service. You should download and save videos you want to keep.
11. Children and Minors
Dancify is intended for users 13 years of age or older. Users under 13 may not use the Service.
If you are under 18, you may use Dancify only with permission and supervision from a parent or legal guardian.
If you upload a photo of a child or minor, you represent that you are the parent/legal guardian or have appropriate permission.
We may restrict child or minor photos to family-safe, age-appropriate templates and may block templates or prompts that are adult-coded, romantic, suggestive, exploitative, unsafe, or otherwise inappropriate.

12. Push Notifications
Dancify may send push notifications for service updates, generation status, account information, promotional messages, or other app-related notices. You may turn off push notifications through your device settings.
13. Your Choices
You may control camera and photo permissions through device settings, use your Apple account settings to manage Sign in with Apple or your Google account settings to manage Google Sign-In, manage subscriptions through the Apple App Store, delete your account in the app, contact us to request access, correction, or deletion of personal information, opt out of marketing emails where applicable, and turn off push notifications through device settings.
14. U.S. Privacy Rights
Depending on where you live and whether applicable privacy laws apply to Dancify, you may have rights to request access, correction, deletion, portability, or information about how we process personal information.
We do not currently sell personal information or share personal information for cross-context behavioral advertising. We do not knowingly sell or share personal information of users under 16.

15. Canadian Privacy Rights
Burgess Enterprises Inc is based in Canada. Depending on applicable Canadian privacy laws, you may have rights to access, correct, or request deletion of personal information we hold about you.

16. EEA, UK, Swiss, and Other International Privacy Rights
If you are located in the European Economic Area, United Kingdom, Switzerland, or another region with similar privacy laws, you may have certain rights regarding your personal information, subject to legal exceptions. These rights may include access, correction, deletion, restriction or objection to processing, portability, withdrawal of consent where processing is based on consent, and complaining to a data protection authority.

17. International Users and Data Transfers
Dancify is operated from Canada, and service providers may process information in Canada, the United States, and other countries. These countries may have privacy laws different from those in your location. By using the Service, you understand that information may be processed and stored in countries outside your country of residence.
18. Security
We use commercially reasonable safeguards to protect information, which may include encryption in transit, access controls, secure cloud infrastructure, and limited internal access. No method of transmission or storage is completely secure. We cannot guarantee absolute security.
19. Third-Party Services
The Service may integrate with or link to third-party services such as Apple, Fal.ai, AWS, Meta/Facebook, TikTok, Instagram, YouTube, or other platforms. We are not responsible for the privacy practices of third-party services. If you share a generated video to another platform, that platform’s privacy policy and terms apply.
20. Sign-In Options and Account Choice
Dancify offers more than one way to sign in. In addition to Google Sign-In, we offer Sign in with Apple as an equivalent login option. Sign in with Apple limits the information shared with us to your name and email address, lets you keep your email address private using Apple’s private email relay, and does not track your in-app activity for advertising. You may choose whichever sign-in option you prefer.
21. Photo Access and Data Minimization
Dancify only accesses the specific photo you select to create a video. We do not read, scan, or upload your entire photo library, and we do not request access to photos, contacts, location, or other device data that are not needed for the core function of generating your video. You control camera and photo permissions at any time through your device settings, and you can use your device’s photo picker to share only the image you choose.
22. User-Generated Content, Sharing, and Reporting
Dancify lets you create videos from photos you provide and, where available, share or download those videos. You are responsible for the photos you upload and the videos you create, and you must have the rights and permissions needed for any image you upload, including images of other people. You may not use Dancify to create content that is illegal, abusive, harassing, sexually exploitative, deceptive, or that violates another person’s rights.
We use automated and template-level controls to limit unsafe or inappropriate inputs and outputs, and we may restrict, remove, or refuse to generate content that violates these rules or our Terms of Service. If you encounter content you believe is objectionable, abusive, or violates these rules, or if you wish to report misuse of your image, you may contact us at hello@dancifyapp.com, and we will review and respond. We may also suspend or block users who misuse the Service.
23. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we will update the effective date and may provide notice through the Service, push notification, pop-up notice, email, or other reasonable means.
